DISTANCE SALES AGREEMENT

ARTICLE 1- SUBJECT

The subject of this contract covers the rights and obligations of the parties in accordance with the provisions of the Law No.4077 on the Protection of Consumers - Regulation on Distance Contracts regarding the sale and delivery of the product that the SELLER sells to the BUYER, whose qualifications and sales price are specified below.

ARTICLE 5- GENERAL PROVISIONS

5.1.The BUYER declares that he / she has read and informed all the preliminary information regarding the basic characteristics, sales price and payment method and delivery of the contract product specified in Article 4 and gives the necessary confirmation electronically.

5.2.The product subject to the contract is delivered to the BUYER or the person / organization at the address indicated in the preliminary information, depending on the distance of the BUYER's place of residence for each product, provided that it does not exceed the legal 30-day period. This period can be extended for a maximum of 10 days, provided that the consumer is notified in writing.

5.3. If the product subject to the contract is to be delivered to another person / organization other than the BUYER, the SELLER cannot be held responsible if the person / organization to be delivered does not accept the delivery.

5.4 The SELLER is responsible for the delivery of the contractual product in a sound, complete, in accordance with the qualifications specified in the order. The SELLER may supply goods or services of equal quality and price to the CONSUMER before the contractual performance obligation expires, provided that it is justified.

5.5. For the delivery of the contractual product, this contract must be confirmed electronically and the contract price must be paid. If, for any reason, the product price is not paid or is canceled in the bank records, the SELLER is deemed to be freed from the product delivery obligation.

5.6. If the SELLER cannot deliver the product subject to the contract within the period due to force majeure or extraordinary circumstances such as adverse weather conditions that prevent transportation, it is obliged to inform the BUYER. In this case, the BUYER may use one of the rights to cancel the order, to replace the product subject to the contract with a precedent, and / or to postpone the delivery period until the preventive situation disappears.

If the BUYER cancels the order, the amount paid will be returned to him within 10 days.

5.7. In the event that the payment obligation of the BUYER in this contract does not materialize in any way, the SELLER may initiate enforcement proceedings for the purpose of collecting the price of the product that cannot be collected, the price of the product on the delivery date and the interest to be charged at the interest rates stipulated in the contract, a claim may be filed and other legal remedies.

 

ARTICLE 6- RIGHT OF WITHDRAWAL

According to clause c, clause 4, article 7 titled Right of Withdrawal of the Regulation on Distance Contracts; The consumer cannot use his right of withdrawal in goods prepared in line with the consumer's wishes or clearly his personal needs. In addition, the consumer does not have the right to withdraw from the contracts for the delivery of goods that are not suitable for return and are in danger of rapid deterioration or are likely to expire.

ARTICLE 7- AUTHORIZED COURT

In the implementation of this contract, the Consumer Arbitration Committees and the Consumer Courts in the settlement of the BUYER or the SELLER are authorized up to the value announced by the Ministry of Industry and Trade.
